Liability for content

As a service provider we are responsible for our own content on these pages under general law pursuant to § 7(1) TMG. Under §§ 8 to 10 TMG, however, we are not obliged as a service provider to monitor transmitted or stored third-party information or to investigate circumstances indicating unlawful activity.

Obligations to remove or block the use of information under general law remain unaffected. Liability in this respect is, however, only possible from the point in time at which a concrete infringement becomes known. If we become aware of such infringements, we will remove the content in question immediately.

Virtual items without monetary value

Coins, experience points, moods, skins, accessories and achievements are virtual items without independent monetary value and cannot be exchanged for cash or other assets. Details are set out in §7 of the Terms. The course of the game (level of happiness, frequency of certain moods, prices in the shop) may change with future updates; this gives no entitlement to the previous state.

The freely chosen name of the Gotchi

From Premium onwards, the name of the Gotchi can be chosen freely. This name is information provided by the user within the meaning of §§ 8 to 10 TMG; it is not checked for content before it is displayed, nor could that reasonably be expected of us. The account that set the name is solely responsible for it. If we become aware of a specific infringement (for example an offensive or unlawful name), we will suspend the account concerned where necessary. Please send any reports to [email protected].

Your own game progress and backups

Without a signed-in account, the game progress is stored only on the device and is not backed up on our server; it is lost if the app is removed or the local storage is cleared. The user is responsible for backing up their own game progress. We give no guarantee that locally stored data will remain available.

Advertising

In the free tier, banner ads are shown via Google AdMob, as well as video ads (rewarded ads) that you can choose to watch in return for one coin. We have no influence on which individual ads are selected; the advertiser concerned is responsible for the advertised offer and the content of the linked pages. Which data is processed in the process is set out in the privacy policy.

Liability for links

Our offering contains links to external websites of third parties over whose content we have no influence. We therefore cannot accept any responsibility for this third-party content. The respective provider or operator of the pages is always responsible for the content of the linked pages. The linked pages were checked for possible legal infringements at the time of linking; unlawful content was not discernible at that time.

Permanent monitoring of the content of the linked pages is not reasonable without concrete indications of an infringement. If infringements become known, we will remove such links immediately.

The content and works created by the site operators on these pages are subject to copyright law. Reproduction, editing, distribution and any kind of exploitation outside the limits of copyright require the written consent of the respective author or creator.

Insofar as the content on this page was not created by the operator, the copyrights of third parties are respected. In particular, third-party content is identified as such. Should you nevertheless become aware of a copyright infringement, please let us know. If infringements become known, we will remove such content immediately. The character, expressions and skins of MyGotchi in particular are also subject to copyright.

Availability

We endeavour to keep the service available at all times but do not owe this. Maintenance work, technical faults and events beyond our control may lead to temporary restrictions. Details are set out in the sections “Availability & changes” and “Liability” of the Terms.
